Copyright and DMCA Policy
Last updated: August 25, 2026
[COMPANY LEGAL NAME, LLC] respects copyright and expects everyone on CarTour to do the same. This page explains how to tell us about material you believe infringes your copyright, how someone can respond if their content is removed by mistake, and what happens to accounts that infringe repeatedly.
It is part of the Terms of Service.
Content on CarTour is uploaded by dealerships
Vehicle videos, photographs and descriptions are published by dealerships, not by us. A dealership that uploads media confirms it owns or has licensed everything in it — including background music, which is the most common way a walkaround video infringes someone's copyright. A track bought for personal listening is not licensed for use in an advertisement.
Reporting infringement
If you own a copyright, or are authorised to act for the owner, and believe material on CarTour infringes it, send a written notice to our designated agent with all six of the following. A notice missing any of them may not be effective, and we may not be able to act on it.
- A physical or electronic signature of the copyright owner, or of a person authorised to act on their behalf.
- Identification of the copyrighted work you say has been infringed — or, if several works are covered by one notice, a representative list.
- Identification of the material you say is infringing, with enough detail for us to find it: the listing URL or the vehicle's VIN and the dealership's name, and where in a video the material appears.
- Your contact details — name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorised to act on their behalf.

[COPYRIGHT EMAIL]
Email is the fastest route. Notices about anything other than copyright should go to [SUPPORT EMAIL] instead — please do not send general complaints to the copyright agent, as it delays the notices that belong there.
Please do not misuse this process
Under 17 U.S.C. § 512(f), a person who knowingly misrepresents that material is infringing may be liable for damages, including costs and legal fees. If you are not sure whether a use is infringing — for example, whether it is fair use — get legal advice before sending a notice.
What we do with a notice
- We remove or disable access to the material, usually within two business days of receiving an effective notice.
- We notify the dealership or user who posted it, and give them a copy of the notice, including your name and contact details. Assume the person who posted the material will see who complained.
- We record the notice against that account for the purposes of our repeat-infringer policy.
Counter-notice: if your content was removed by mistake
If your material was removed and you believe that was an error, or that you have the right to use it, you may send a counter-notice to the agent above containing all of the following:
- Your physical or electronic signature.
- Identification of the material that was removed, and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, postal address and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the district where you live — or, if you are outside the United States, of any district in which we may be found — and that you will accept service of process from the person who sent the notice, or their agent.
We forward an effective counter-notice to the person who complained. If they do not tell us within 10 to 14 business days that they have filed a court action seeking to restrain the activity, we may restore the material.
The same warning applies in this direction: a knowing misrepresentation in a counter-notice carries liability under § 512(f).
Repeat infringers
We terminate the accounts of repeat infringers. An account that is the subject of repeated effective notices — ordinarily three that are not successfully countered — is terminated, along with any other accounts held by the same person or dealership. Where the infringement is flagrant, one notice is enough.
For a dealership account, termination under this policy is a breach of the Dealer Subscription Agreement and does not entitle it to a refund.
Trademarks and other rights
This procedure is for copyright. For trademark complaints, right-of-publicity claims (for example, appearing in a video without consent), or defamation, write to [LEGAL EMAIL] with the same level of detail — what the right is, where the material is, and why it is a problem.
Our own material
The CarTour name, logo, interface and software belong to [COMPANY LEGAL NAME, LLC]. Dealerships may use our name and marks to say they list with CarTour, and for nothing else without our written permission.
